Professor Adams assertions certainly deserve further consideration and restitution if found to be true. Her contention that she was paid less than other associate professors specifically should be examined and determined whether or not she was indeed receiving pay which was less than males who were also on their three-year probationary period (Pregnant). If her claims of less pay are based upon comparisons with professors who have already passed their probationary period, then it is not a valid comparison and adds to the case against her. However, in the rest of the claims she makes it does not appear that she has a valid argument for a discrimination suit. Part of the agreement she made was to publish multiple articles and to participate in committees. Professor Adams was only able to publish twice which was less than her colleagues. In addition, the department states that she did not fulfill her obligations outside of the classroom. She claims that the conferences were held during her pregnancy, but there is no mention of any conferences that she attended outside of this time frame. The case specifies that the period of her leave of absence was not counted in her probationary period, leaving a space of three months activity which is unaccounted for. Although the professor had high praise regarding her teaching abilities, there is more to being a professor than this. Professors are part of a community of scholars and tasked with contributing to the larger scholarship within their field. This is an obligation which Professor Adams simply did not live up to.

There are several incidents that occurred at the All Erection Crane Company which seem to be definite indications of sexual harassment. First, there is nothing appropriate with Eddie Ellis’s comments about the receptionist Gayle’s breast size (Boys). He claims that he has not committed harassment because he has only talked about them, not touched them or made sexually explicit comments. However, any mention of the female body is inappropriate in the workplace, as is the display of women in lingerie both in and on his locker. His actions contribute to the atmosphere within the work place wherein Gayle is made an object of sexual attention to the customers as well. Even though she has not complained herself about the interactions, Gayle is being made an object because of her gender and the body parts associated with being a female.
Further, Dave French even hinting that Marie Sanchez’s work evaluation will be affected by whether or not she has gone out with him is a serious infraction. By making her believe her job might be in jeopardy based upon anything other than what goes on with the business of the office is a severe case of sexual harassment. Eddie and Dave’s behavior towards Dale Fox is also an example of sexual harassment as they use his alleged sexuality and traditionally female products with the direct intent of making him feel uncomfortable at work (Paludi 1991,-page 2).
In response to these instances, rather than give the perpetrators a slap on the wrist and a talking to, the owner of the company must take a stand against these actions. First and foremost, the company should create a policy wherein no sexually-based conduct or conversation is allowed. No images of women in their underwear should be permitted either in lockers or on them. Mentioning of female body parts should not be tolerated nor should behaviors which are homophobic. The very discussion of a coworker’s sexual preference is not appropriate in the workplace. In Dave French’s case, immediate dismissal should be the consequence of his actions as he made what seems to be the most egregious offense.
